2. Auxilious Services
Auxilious provides brokerage-management technology and related functionality. Features, configurations, availability, and third-party connections may vary and may evolve over time.
3. Eligibility and Business Use
Auxilious is intended primarily for professional and business use associated with real-estate brokerage operations. You must have authority to use Auxilious on behalf of an organization or account when applicable.
4. Accounts
Some services may require an authenticated account. Users are responsible for maintaining the confidentiality of their credentials, limiting access to authorized persons, and notifying Auxilious through the contact page if unauthorized use is suspected.
5. Acceptable Use
You may not use Auxilious to:
- Violate law or infringe another person’s rights.
- Access accounts, data, or systems without authorization or misuse another user’s account.
- Interfere with, disrupt, damage, or circumvent service or security controls.
- Upload malicious software or harmful content.
- Scrape or automatically extract information without authorization.
- Misuse AI-enabled functionality, integrations, or outputs.
6. Brokerage and Professional Responsibility
Auxilious provides technology, not professional services. Brokerages and licensed professionals remain responsible for brokerage operations, supervision, professional judgment, licensing and regulatory obligations, transaction decisions, legal requirements, and the accuracy and suitability of information they provide or use. Auxilious is not acting as a law firm, real-estate brokerage, lender, title company, accountant, or compliance authority.
7. AI-Enabled Features
AI-generated outputs may be inaccurate, incomplete, or unsuitable for a particular situation. Users must review outputs before relying on or communicating them. AI functionality does not replace professional judgment, legal advice, compliance review, or brokerage supervision.
8. Third-Party Services and Integrations
Supported integrations depend on third-party APIs, permissions, accounts, terms, and continued availability. Auxilious does not control third-party services, and changes made by their providers may affect connected functionality.
9. Intellectual Property
Auxilious software, branding, content, interfaces, documentation, and proprietary technology are protected by applicable intellectual-property laws. Except for rights expressly granted for authorized use, no rights are transferred to you. These Terms do not claim any registration that has not been obtained.
10. Customer and User Content
You retain the rights you hold in content and data you provide. You authorize Auxilious to host, process, transmit, display, and otherwise use that content as reasonably necessary to operate, support, secure, and improve the applicable services and fulfill authorized instructions, subject to applicable agreements.
11. Feedback
If you voluntarily provide product suggestions or feedback, Auxilious may use them to evaluate or improve its offerings without an obligation to compensate you, provided this does not grant Auxilious ownership of your separate customer or brokerage data.
12. Pricing
Current public pricing information may be available on the Pricing page. Actual fees and commercial terms, including subscription, implementation, cancellation, and renewal terms, will be governed by the applicable customer agreement or order.
13. Availability and Changes
Auxilious may modify, add, suspend, or discontinue website or service functionality. We do not promise that every feature or integration will remain available or that operation will always be uninterrupted or error-free.
14. Disclaimers
To the extent permitted by applicable law, Auxilious websites and services are provided on an “as available” basis. Auxilious does not warrant that information, software, AI outputs, or third-party connections will be error-free or fit every user’s particular purpose. Rights that cannot legally be waived remain unaffected.
15. Limitation of Liability
To the extent permitted by applicable law, Auxilious will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from use of or inability to use the website or services. Any additional allocation of liability for paid services must be stated in the applicable commercial agreement. Some jurisdictions do not allow certain limitations, so these limitations may not apply in every circumstance.
16. Indemnification
To the extent permitted by applicable law, you are responsible for claims resulting from your unlawful use of Auxilious, violation of these Terms, or infringement of another person’s rights. Any broader indemnification obligations for commercial customers must be established in a separate written agreement.
17. Suspension and Termination
Website or account access may be limited, suspended, or terminated when reasonably necessary to address a violation of these Terms, unauthorized or harmful activity, legal requirements, or loss of authorized access. Subscription cancellation and post-termination obligations will be governed by the applicable customer agreement.
18. Changes to These Terms
We may update these Terms as Auxilious and applicable requirements change. The date above will be updated when revised Terms are posted. Continued use after an update may constitute acceptance where permitted by law.
